Founding Attorney, Branson Trial Law
Joshua Neally is an attorney licensed in Missouri and Florida who represents timeshare purchasers in disputes against the resorts that sold to them. He has been personally sued by a Branson timeshare resort for his representation of the resort’s former customers, and he won both at the trial court and on appeal in the Missouri Court of Appeals, Southern District.
Joshua brings an uncommon combination of experience to timeshare cases. From 2007 through 2013, he served as in-house counsel for a prominent Branson timeshare resort, where he led the legal department and handled consumer, contract, employment, and commercial litigation for the company. That seven-year tenure gave him a working understanding of how timeshare resorts draft their contracts, train their sales teams, structure their “owner update” meetings, and respond to purchaser complaints. He now applies that knowledge on behalf of the purchasers themselves, the people on the other side of the transactions he spent seven years observing from inside.
Before moving to Missouri, Joshua served as a prosecutor in Florida’s 19th Judicial Circuit, covering St. Lucie County and Indian River County. That trial-court experience, taking cases from charging decision through jury verdict, shaped the way he approaches civil litigation today, including an emphasis on early case evaluation, disciplined preparation, and a willingness to take cases to trial or final arbitration hearing when the other side refuses to deal fairly.
Joshua earned his Bachelor of Arts in Political Science from the University of Iowa in 2003 and his Juris Doctor from the University of Iowa College of Law in 2006. He was admitted to the Florida Bar in 2006 and to the Missouri Bar in 2009. He has been in continuous private practice since 2013.
His current practice focuses on representing timeshare owners with claims under the Missouri Merchandising Practices Act (RSMo § 407.010 et seq.), common-law fraud, negligent misrepresentation, and breach of contract. Joshua handles both litigation in Missouri state court and arbitration proceedings under the mandatory arbitration clauses that most timeshare contracts now contain. Because RSMo § 407.025 allows prevailing consumers to recover reasonable attorney fees, these cases can be economically viable for purchasers who could not otherwise afford to litigate against a well-funded resort.
Beyond timeshare work, Joshua represents clients in general consumer protection, real estate, and contract disputes. His office is in Branson, Missouri, where most of the timeshare disputes he handles originated.
